A BILL to amend article five-b, chapter thirty-eight of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
seventeen, relating to allowing garnishment of the wages of
federal employees.
Be it enacted by the Legislature of West Virginia:
That article five-b, chapter thirty-eight of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated section
seventeen, to read as follows:
ARTICLE 5B. SUGGESTION OF THE STATE AND POLITICAL SUBDIVISIONS;
GARNISHMENT AND SUGGESTION OF PUBLIC OFFICERS.
§38-5B-17. Application to a federal employer and federal
agenc
ies.
Notwithstanding any other provision to the contrary, a judgment creditor may apply to the court for a suggestee
execution against any money due or to become due within one year
after the issuance to the judgment debtor from any federal
employer or a federal agency. The provisions of this article
which are applicable to the state and its subdivisions are
likewise applicable to the federal government and its agencies.
NOTE: The purpose of this bill is to allow the wages of
federal employees to be garnished.
